1. Acceptance of Terms

By accessing or using STRYK ("the Platform"), operated by STRYK Inc. ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and STRYK Inc.

2. Description of Service

STRYK is a peer-to-peer task marketplace where users can post tasks, challenges, dares, gigs, and errands ("Stryks") with monetary prices, and other users can accept, bid on, or negotiate to complete them. STRYK is solely a platform that facilitates connections between posters and strikers. STRYK is not a party to any task agreement, does not employ or contract any users, and does not supervise, direct, or control the performance of any Stryk.

3. Eligibility & User Accounts

• You must be at least 18 years old to create an account and use STRYK. By using the Platform, you represent and warrant that you are at least 18 years of age.
• You are responsible for maintaining the security of your account and all activity under it.
• One person may not maintain multiple accounts.
• You agree to provide accurate, current, and complete information during registration.
• You acknowledge that STRYK involves tasks that may include physical activities, challenges, and dares, and you confirm that you are legally capable of entering into binding agreements.

4. Posting & Completing Stryks

• Posters must provide accurate descriptions of the task required.
• When you post a Stryk with a price, that amount is held pending task completion and approval.
• Strikers must complete tasks as described and submit proof of completion.
• Upon poster approval, 90% of the price is paid to the striker. STRYK retains a 10% platform fee.
• If a Stryk is cancelled before completion, funds are refunded to the poster.
• STRYK does not guarantee that any Stryk will be accepted or completed.

5. Independent Relationship

All users of STRYK — both posters and strikers — act as independent parties. Strikers are NOT employees, agents, or independent contractors of STRYK. STRYK does not control how, when, or where a striker performs a task. The relationship between a poster and a striker is solely between those two parties. STRYK has no liability for the actions, omissions, or conduct of any user.

To the maximum extent permitted by law, you hereby release, waive, and discharge STRYK Inc., its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, and expenses (including attorney's fees) arising out of or related to:

• Your participation in any Stryk, whether as a poster or striker
• Physical injury, illness, death, or property damage resulting from any Stryk
• Interactions between users, whether online or in person
• Any dispute between a poster and a striker
• The conduct of any third party on the Platform

This waiver applies regardless of whether the claim arises from negligence, strict liability, or any other legal theory, except in cases of STRYK's willful misconduct or gross negligence.

8. Indemnification

You agree to indemnify, defend, and hold harmless STRYK Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Platform or participation in any Stryk
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any content you post on the Platform
• Any harm caused to a third party as a result of your actions on or through the Platform

9. Prohibited Content & Conduct

You may not post Stryks that involve or promote:

• Violence, threats, or harassment against any person
• Hate speech, discrimination, or targeting based on protected characteristics
• Illegal activities, including drug sales, theft, or trespassing
• Tasks that are designed to endanger the health or safety of any person, including the striker
• Sexual exploitation, pornography, or content involving minors
• Fraud, scams, phishing, or deceptive practices
• Doxxing, stalking, or sharing private information without consent
• Self-harm, suicide, or activities with an unreasonable risk of death
• Tasks that require violating another person's rights or property
• Any activity that would require professional licensing the user does not possess

STRYK uses automated moderation and community reporting to enforce these rules. Violations may result in content removal, escrow forfeiture, account suspension, or permanent bans. STRYK reserves the right to remove any content at its sole discretion.

10. Payments & Fees

• STRYK charges a 10% platform fee on completed tasks, deducted from the payout to the striker.
• Payments are processed through our third-party payment provider (Stripe). STRYK is not responsible for payment processing errors by the provider.
• Users are solely responsible for reporting and paying any applicable taxes on income earned through the Platform.
• STRYK may issue tax forms (e.g., 1099) as required by law.

11. Disputes Between Users

If a poster and striker disagree on task completion, either party may submit a dispute. STRYK will review submitted proof and make a determination. While STRYK endeavors to be fair, STRYK's decision on disputes is final and binding. STRYK is not obligated to mediate or resolve any dispute between users.

12. Intellectual Property

• You retain ownership of content you post on STRYK.
• By posting content, you grant STRYK a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the Platform and in marketing materials.
• You may not post content that infringes on the intellectual property rights of others.
• STRYK will respond to valid DMCA takedown notices. For IP or DMCA concerns, contact legal@strykme.com.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRYK IS PROVIDED "AS IS" AND "AS AVAILABLE." STRYK INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS OF PROFITS, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE PLATFORM OR PARTICIPATION IN ANY STRYK.

STRYK's total aggregate liability shall not exceed the platform fees paid to us by you in the 12 months preceding the claim, or $100, whichever is greater.

14. Arbitration & Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of STRYK shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Delaware or remotely at the claimant's election.

You agree to waive the right to participate in a class action lawsuit or class-wide arbitration. All claims must be brought in your individual capacity.

15. Termination

STRYK may suspend or terminate your account at any time for violations of these Terms or at our sole discretion. You may delete your account at any time through Settings. Upon account deletion, outstanding funds will be handled according to our data retention and account deletion policies (see Privacy Policy). Sections 6–8, 13, and 14 survive termination.

16. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. We will notify users of material changes via email or in-app notification at least 14 days before they take effect.
